Dear Sir,
I am following up on exchanges between the services of the Commission Nationale de l'Informatique et des Libertés (hereinafter the "CNIL") and the legal department of as part of the investigation of the complaint sent to us by the personal data protection authority of the German Land of North Rhine-Westphalia ("der Landesbeauftragte für Datenschutz and Informationsfreiheit Nordrhein-Westfalen"), pursuant to the provisions of Article 56.1 of the General Data Protection Regulation (hereinafter "GDPR").
This complaint concerned the difficulties encountered by Mr in exercising his right to object to receiving commercial prospecting by e-mail from
The complainant, who had been a subscriber to the newsletter since 23 September 2020, attempted to unsubscribe from the mailing list by clicking twice on the unsubscribe link displayed on the email concerned, without success.
When questioned on this subject by the CNIL, first confirmed that it had received a request for deletion from Mr on 30 September 2020 at the e-mail address and that it had informed him on 1st October 2020 that his request had been taken into account. However, it then acknowledged that, due to human error, Mr's personal data had not been correctly deleted.
It therefore confirmed to the CNIL on 23 March 2022 that it had removed the complainant from the newsletter mailing lists and his account. The company informed him of this in a letter dated 22 April 2024.
The responses provided and the measures taken by have led me, in agreement with the other European data protection authorities concerned, to close this complaint.
