Summary of the case
You have on the 17th of august lodged a complaint to the Swedish Data Protection
Authority (IMY). You have in your complaint stated that you tried to access your
personal data from Bike Soul SSDrl (Bike Soul) but have not received any answers
from them. IMY have, in line with article 56 in the GDPR1, turned the complaint over to
the Italian Data Protection Authority (Garante Per La Protezione Dei Data Personali,
hereinafter Garante) as lead data protection authority. Garante have according to
article 60.3 presented a draft decision (see appendix) to the concerned Data
Protection Authorities. None of the concerned Data Protection Authorities have
objected to the draft decision.
Assessment of the case
The draft decision from the Guarantor mainly indicates the following. Bike Souls have
in a letter to Garante stated that the company have not received any official request of
access to your personal data from you. This is because, inter alia, the email address
you provided in the complaint is not the same as the one listed on the Bike Souls
website. Furthermore, It is stated in the guideline 1/2022 on transparency from the
European Data Protection Board that the data controller is not obligated to respond to
a request sent to a randomly chosen email address for the data controller.
Additionally, Bike Souls have further explained that your personal data was erased on
the 31st of December 2021.
Considering these facts, Garante found no reason to investigate the complaint further.

How to appeal
If you want to appeal the decision, you should write to the Swedish Authority for
Privacy Protection. Indicate in your letter which decision you are appealing and the
amendment you are requesting. The appeal must be received by the Swedish
Authority for Privacy Protection no later than three weeks from the date you received
the decision. If the appeal has been submitted in a timely manner, the Swedish
Authority for Privacy Protection will forward it to the Administrative Court in Stockholm
for examination.
You can email the appeal to IMY if it does not contain any sensitive personal data or
information that may be subject to confidentiality. The authority's contact details can be
