Data protection complaint
Subject: Record of the closure of the proceeding following an amicable resolution according
to the Guidelines 06/2022 of the European Data Protection Board
1. On 7 February 2021, the complainant lodged a complaint with the Austrian
Data Protection Authority against (respondent), established in the
Netherlands, alleging an infringement of the right of access due the fact that the respondent did not
respond to his request of 6 January 2021 to that effect.
2. The Dutch Supervisory Authority declared itself as the lead supervisory authority, conducted
an investigation and informed the Austrian Data Protection Authority that the respondent has now
provided the requested information.
3. The complainant was informed of the outcome of the investigation by letter from the Austrian
Data Protection Authority dated 16 April 2025.
4. As the complainant did not react within the right to be heard anymore, the Dutch Supervisory
Authority adopted a draft decision and proposed to close the present proceeding. The draft decision
has not been objected by the concerned supervisory authorities and thus became binding.
5. For this reason, the present proceeding was to be closed informally and the Austrian Data
Protection Authority hereby brings this to your knowledge.
